35 MPH Now Qualifies as Moped in Virginia

For those of you who have TGB mopeds and live in Virginia, you should know that as of July 1, 2008 the State Assembly changed the moped definition from a max of 30 MPH to a max of 35 MPH.  All other rules are the same (50 cc max displacement, etc.). 

In theory, that means you could tweak a 30 MPH moped to run at 35 MPH (also, keep in mind that speedos are likely to overstate true speed -- on my R50X the 37 MPH top speed reading is really 31 MPH -- so don't go by the display).  However, there is a thread in another section of the Forum in which TGB's Bill Peirce warns that running the engine at constant high revs over 30 MPH can accelerate engine wear.
