tgb 304 sport help needed

Hi everyone I'm new to the site but I have just brought a tgb 304 sport 58plate and it doesn't run. The previous owner said it ran out of petrol and wouldn't start again after that. I've tried starting it and it turns over but won't start, it sounds like it wants to start if you put the throttle on but then the battery dies so can't do anything. I've ordered a new battery and spark plug but was wondering if anyone would have an idea what this could be. Carb need cleaning/ replacing, bad petrol or something totally different. Any help would be appreciated

what scooter is that ?
2 stroke or 4 stroke?
does it have spark?
 did you try some starting fluid?
how long has it sat with old gas?
are you trying to start it with old gas still in the tank?

Its a tgb 304. Sport or hawk
Yes it has spark but plug is black and not even damp
I'm not sure the previous owner said that they have not long put fuel in it. I've had the fuel pipe off the carb and petrol is flowing to it.
Yes I'm trying to start. It with the fuel the previous owner has put in

 Its a 4 stroke and no not tried no starter fluid I don't even know what that is :-\

starting fluid  is either  comes in a spray can like
spray paint , get it at a auto parts store ,give a short shot
into the air box and it should fire up 
if it runs for 30 seconds or so and dies try again if it keeps doing
that its fuel related if it doesn't fire its a spark related issue

 foul or old fuel makes for hard starting or if its really bad
it will just gunk up the carb
